Service Agreement Terms
1. Service Description
Sailer Painting provides professional residential and commercial painting services throughout North Dakota. Our services include interior and exterior painting, surface preparation, cabinet refinishing, decorative finishes, and related construction services.
2. Project Estimates and Pricing
All project estimates are provided based on current market conditions and material costs. Final pricing may be adjusted if scope changes occur during the project or if unforeseen conditions are discovered. Estimates are valid for 30 days from the date of issuance.
3. Payment Terms
Payment is due according to the schedule outlined in your service agreement. Typical terms include a deposit upon contract signing, progress payments during work completion, and final payment upon project completion and customer approval.
4. Customer Responsibilities
Customers are responsible for:
- Providing reasonable access to the work area
- Removing or protecting personal belongings and furniture
- Ensuring adequate ventilation and workspace conditions
- Making timely decisions regarding color choices and finish selections
- Providing access to utilities (electricity, water) as needed
5. Workmanship Warranty
We stand behind our work with a comprehensive warranty on painting labor and materials. Warranty terms vary by service type and will be detailed in your specific service agreement. This warranty covers defects in workmanship and material failure under normal conditions.
6. Timeline and Delays
Project timelines are estimates based on weather conditions, material availability, and scope of work. Delays caused by force majeure events, material shortages, or scope changes may extend completion dates. We will communicate any timeline changes promptly.
7. Change Orders
Changes to the original scope of work must be documented through change orders signed by both parties. Additional costs and timeline impacts will be clearly outlined before work proceeds.
8. Site Conditions
We work in various conditions and cannot be held responsible for damage caused by pre-existing structural issues, moisture problems, or other hidden conditions discovered during painting preparation.
9. Cleanup and Disposal
We maintain clean work sites and provide thorough cleanup upon project completion. We are responsible for proper disposal of painting materials and debris generated by our work.
10. Limitation of Liability
Our liability is limited to the cost of the project. We maintain appropriate insurance coverage and are not responsible for consequential damages, unless specifically outlined in your service agreement.
11. Governing Law
These terms are governed by the laws of the State of North Dakota. Any disputes will be resolved through binding arbitration or in the appropriate North Dakota courts.
